Introduction

We are happy to welcome you to our website www.etam.com (hereinafter referred to as the “Website”).

These general sales conditions exclusively govern the sale of products offered on the Website. They are systematically made available to the customer on the Website when any order is placed.

Therefore, placing an order implies that the Customer fully accepts all of the general sales conditions without reserve, overriding any other sales conditions found in advertising or catalogues from the vendor and, in particular, the conditions applicable in Etam shops.

They cannot be held to any additional or differing conditions set forth by the Customer, unless expressly accepted by them, no matter when the condition was brought to the attention of Etam. Should Etam choose not to avail itself of any one of the present general sales conditions, this can in no way be interpreted as a waiving of that right by Etam and that right may be invoked at a later stage.

We do our utmost to ensure that the information provided on the Website is correct and up to date; we reserve the right to correct the contents of this Website at any time and without warning.

If any circumstances not provided for herein arise, they shall be governed by French laws concerning distance sales.

Purpose

These terms and conditions govern the sale of Etam "prêt-à-porter" and "lingerie" articles on the web site of ETAM PRET A PORTER SAS, which has a stock capital of 5 846 820 Euros and is registered in Nanterre under the company number B 337 598 866 and has its registered office at - 57-59, rue Henri Barbusse - 92614 Clichy Cedex - France (hereinafter "Etam") to all non merchants who are physical persons aged 18 and above.

Availability of products

Delivery to 20 countries + French overseas territories (except Guyana): Austria – Azores- Belgium – Denmark – Germany – Finland – mainland France - Ireland - Italy - Luxembourg - Madeira - the Netherlands – Norway - Portugal – Spain – Sweden – Switzerland – the United Kingdom. All products offered for sale are subject to availability.

Price

Prices are given in Euros for the concerned countries. Shipping costs will be added to prices, where applicable.
Your order implies acceptance of the price and description of products available for sale. 
Any dispute regarding this matter will be dealt with in the “exchange/return” process described below.
We reserve the right to modify prices and descriptions in the event that costs increase, notably the VAT rate, and in the event that we have made a typing or data input error.

While we do everything in our power to list prices accurately on our website, pricing errors may arise. Any orders involving obviously incorrect prices due to a pricing error shall be cancelled, irrespective of whether the order has been validated by our personnel.

Orders

All orders placed on the web site must be paid for with a payment card of your choice: CB, Visa, Mastercard, Amex as well as all country variations of these cards. 
Your order will only be placed after you have entered your bank card number. 
This payment will then be validated by GIE carte bancaire.
All web site users who do not have a Customer number must register to obtain a one.
This number is personal. In the event that this number is lost, you must contact Etam Customer Services as soon as possible; the contact details can be found above. In all cases, entering your bank card number online and final validation of the order constitutes proof of your order in accordance with the provision of the law dated 13 March 2000 and payment must be made for all articles mentioned on the purchase order.
This validation constitutes a signature and express acceptance of all the operations carried out on the web site.
However, should you notice that your bank card has been used fraudulently, please contact our customer services as soon as you notice any irregularity. Final order validation takes place after payment validation.
Once you have placed your order, you will be a sent a confirmation email summarising your order and the delivery address.

Product returns/exchanges

Following the date you receive your order, you have 30 days in which to return your order (unworn and in its original packaging). To do this, please follow the return instructions indicated on your return slip.
Please be aware that articles returned by customers must be intact and any damaged or soiled articles will not be accepted.

Exchange or refund? It's up to you!

  • Exchange or refund in one of our stores: You can exchange your article or get a refund in any Etam Prêt-à-Porter or Etam Lingerie store, depending on the product, in mainland France. If you paid for your order using a gift card, you may only exchange the item.
  • Getting a refund when you return goods to our warehouse: Should you decide to return the goods to our warehouse, we can only offer a refund. You are responsible for any shipping costs, except if the return is due to an error on our part. You will be reimbursed once we receive the returned goods; this takes approximately ten days. Your bank account will be credited for the amount of the returned articles using our secure payment partner - ADYEN.

In either case, the articles must be returned with the delivery slip duly completed by you. (You will find the return slip in your order package.). Please be aware that if you paid by gift card, e-card or if your bank card has expired, you will need to contact customer services on 01.55.90.75.75 to obtain your refund.

Delivery

Kiala or La Poste delivery options, it’s up to you!

Kiala : With over 4000 Kiala offices in France, there is certainly an office near you. Take advantage of longer opening hours to pick up your package.

As soon as your package is ready for collection in your Kiala office, you will be notified by email or SMS. You have ten days in which to pick up your package.

Coliposte : Your package is delivered to your home or to another address of your choice (indicated on the registration form).

When placing your order, make sure you give as much information as possible regarding your contact details and delivery address.

  • We process packages from Monday to Friday. Generally, orders are dealt with in 2 to 3 working days. Any additional delays are on account of La Poste. Generally, these do not exceed 5 days (for mainland France).
  • Please be aware that during certain periods (sales, private sales, Jours Passion, etc.) our shipping times may be longer due to the large volume of packages to be processed.

If you are not home: a delivery notification slip will be left in your letter etm-box.
Your package will be available for collection for two weeks from the nearest post office.
In the event that your package is not delivered within the usual time frame, you must inform us of this delay within 30 days by sending an email to the following address: customer.service@etam.com
We will then contact the postal services and open an inquiry.

Claims

If you have any questions about an order, please contact our Customer Services department.

In the event that you need to make a claim, please give your customer number as well as the reason for contacting us.

Following the resolution of your problem, and if necessary, your bank card will be credited with the amount in question using our secure payment partner - ADYEN.

Inquiries concerning delivery of a package with the French postal system must be done within 30 days.

In addition, once a “claim” file has been opened, requests for refunds can only be honoured if made within 2 months. Due to our accounting system, we can only reimburse customers within 60 days of the original purchase.

Personal data

The information you provide on this website will be only be used by Etam or its partners and only if the Client expressly authorises it in accordance with the conditions outlined below.

In accordance with Act no. 78-17 of 6 January 1978 pertaining to the protection of individuals with regard to the processing of personal data, you have the right to access and modify your personal data at any time.

Litigation

Placing an order means that you accept these general sales conditions. The present sales conditions are subject to French law.
In the event of a dispute, only the French courts will have jurisdiction.

Secure payment

Etam uses the ADYEN secure payment service, which complies with the SSL security norm. Confidential data (card number, expiry date) are encrypted before being sent to the ADYEN server and are never sent to our server.
The ADYEN server is directly connected to the bank’s server in the country in question.

Liability

The products on offer comply with French law.
Product photographs and product descriptions are not legally binding.

Therefore, ETAM shall not be liable in the event that there is an error in any of these photographs or descriptions.
ETAM shall not be held liable if an order is not completed because of the unavailability of stock; an act of God; a disturbance or general or partial strike by the postal services; delivery and/or communication services; in the event of any damages resulting from the fraudulent intrusion of a third-party leading to the modification of information on the web site; and more broadly any direct or indirect damages whatever their cause, origin, nature or consequences caused by any individual accessing the web site or not being able to access the web site; use of the web site and/or any claims related to any information originating directly or indirectly from the latter.

ETAM will in no way be liable for any indirect damages resulting from these terms and conditions such as operating loss, loss of profit, missed opportunity, damages, and costs.
ETAM reminds you that under article 1124 of the Civil Code, minors are not authorised to place orders. Therefore, any orders intended for minors, must be made on their behalf by a parent or legal guardian. In the event that a minor’s personal data are inadvertently collected, parents and legal guardians can oppose their conservation and/or their transmission to a third party.
Hypertext links can direct users to web sites other than this one. ETAM declines all liability as to the content of these web sites should they contravene any laws or regulations currently in force.

Intellectual property

The use of the  www.etam.com web service is strictly personal.

In accordance with the law governing literary and artistic property or other similar rights, this web site and any of its associated elements, brands, designs, models, logos, graphic images, etc. on the web site and their compilation are the sole property of ETAM or its suppliers. Suppliers do not grant any licences or rights other than to consult the web site.

Term

These terms and conditions will remain in force for the entire term that ETAM places products and services on the Internet for sale.

Proof

The digital records securely saved on Etam’s and its partners’ information systems will be considered as proof of communication, orders and payments between Etam and the Client.

Applicable laws – Jurisdiction

This contract is subject to French law. The language used in this contract is French. In the event of litigation, the French courts will have jurisdiction.

Modification to general sales conditions

Given the likelihood of changes to the web site, ETAM reserves the right to adapt or modify, at any moment, these general sales conditions. The new general sales conditions, where necessary, will be made known to the client by posting the modifications on the web site and will only be applicable to sales made after these modifications.
